Eric Stucky said he had every intention of shooting the man he caught breaking into his home Friday morning in the 2000 block of S.W. West Trail Road. . . .About 10:30 a.m., Stucky said he peeked around the corner from his bedroom to see a large man climbing through the broken window. Returning to the bedroom, he said he heard a second person enter. He said one went to the second floor of his home and the other went into his office. Crouched on his knees, Stucky said the unarmed burglar in his office turned around to discover he was being watched.
As Stucky described it: “Then he started screaming like a little scared girl, 'Please don’t shoot me, please don’t shoot.’ ” . . .
Lucky for the burglar, he didn’t try to escape or make a threatening move while being held at gunpoint.
Pointing his .357-caliber Desert Eagle at the man in his home office, Stucky said he called 911 and explained the situation. He said sheriff’s deputies arrived about four minutes later and took the man into custody. . . .
Once sheriff’s deputies arrived, they arrested Ex’Zabra Smith, 20, of Topeka, who was booked into the Shawnee County Jail in connection with aggravated burglary, felony theft, felony criminal damage to property and a criminal street gang member offense.
After exercising his 2nd Amendment rights in this manner, does anybody think Eric Stucky will be burglarized again anytime soon? The Desert Eagle ought to come with an optional set of clean drawers to be handed out to foiled burglars.

The guy was part of a gang. He could come back and shoot this guy and his family dead at sometime in the future... or get some of his "homies" to do it.
He should have pulled the trigger.

Once again the press goes out of its way to make no mention of the criminal's race. I guess we just have no way of knowing young Ex'Zabra's background...
At least the homeowner admitted he was wrong;which he was. Instead of waiting and taking a shower, etc., he should have called police immediately, that's what they get paid for and he could have explained the situation to them while he was in a defensive position elswhere in the house. It sounds like he was itching for a fight instead of true home defense.

I think the day that you rely on the police to show up, you may as well get a sheep suit. You do realize that the courts have held that they are not really required to protect you or your family?

Since then, the one Republican who voted for it — Joseph Cao — has indicated that he would not support the bill a second time around given the weaker language on abortion in the Senate version. In addition, Florida Rep. Robert Wexler already retired prematurely. Factor in Murtha’s death today, and Pelosi is down to 217 votes — one short of passage. To pass the bill at some point in the next few months, she’ll need to flip a Democrat who is already on record voting against the bill.

Don't think that Republicans can't be sucked in when an anti-Wall Street lynch mob gets its blood up. Recall that Sarbanes-Oxley, the devastating antigrowth response in 2002 to the Enron and Worldcom scandals, was passed with virtually unanimous support by Republicans in Congress, and signed by a Republican president. Recall that last year 85 House Republicans voted for a 90% tax on bonuses for any employee of any bank that took more than $5 billion in TARP money. Investors got some good news last Friday. Stocks resisted following through on Thursday's sharp plunge after (Congress) reached an impasse on bank re-regulation. That's a nice down payment on what investors need a lot more of now: proof that the GOP won't join Democrats in a populist rush to seek revenge against Wall Street.

Contrary to President Obama's promises, voters say special interests have more influence on the political process now than they did a year ago, according to a new poll. The poll, paid for by groups looking to curb the Supreme Court's recent campaign finance ruling, found that majorities of both Republicans and Democrats say special interests have increased their influence since the president took office, and they say Mr. Obama has not done enough to fight back.
